MEDICAL MALPRACTICE CLAIM
Medical malpractice is a legal action that happens when a hospital, doctor or other health care professional, through a negligent act or omission, that deviates from professional standards, thereby causes an injury to a person. The negligence might be the result of errors in diagnosis, treatment, aftercare or health management.
ROAD ACCIDENT FUND
A RAF claim is a paid compensation to a victim who gets injured on the road which stems from an accident, that was not of his/ her fault. The reward is also granted to the dependant of the victim should the victim lose his/ her life in the accident as a breadwinner at home. The claim can only relate to any bodily injuries caused by the accident, and does not relate to any damages to a motor car or other assets
UNDERTAKING IN TERMS OF SECTION 17(4)A OF RAF
The Undertaking in terms of section 17(4)a is a claim for compensation of which is lodged with the Fund, on behalf of the Plaintiff, if issued by the Road Accident Fund.
The undertaking in terms of section 17(4)a, in some trusts can assist with the following if permitted:
- The costs for establishment for the trust
- The costs incurred for the administration of the trust
- The costs of furnishing annual security in terms of Section 77 of the Administration of Estates Act, No 66 of 1965, as amended, if required by the Master of the High Court.
- The costs of future accommodation of the injured in a hospital or nursing home or treatment of or rendering of a service or the supplying of goods of the said injured after the costs have been incurred and on proof thereof.
